Another opportunity to clarify the law about sponsored links (in search engine results) has gone begging ...

As reported in yesterday's Next section of the Age, Telstra has apparently gotten into trouble again over buying sponsored links to be generated when someone keys in AAPT to Google; AAPT being of course one of Telstra's more significant telecommunications competitors DownUnder.

According to the report, Telstra claims that it was its media buyer's fault and has withdrawn the usage as soon as the Age brought it to Telstra's attention.

The question still remains (to be decided by a court some other time) whether or not such links are misleading or deceptive or use as a trade mark?
