Notice and take downMr Kopp writes a book on how to win (or
at least play better) at the online game World of
Warcraft.
He sells the book via Ebay, quite successfully. The owners of the rights to World of Warcraft claim he has infringed their copyright and trade marks ... They use Ebay's Vero procedure to get Mr Kopp's auctions shut
down.
Now Mr Kopp is suing them for his lost sales. Details here, via the Trademark Blog. Now, apart from Ebay (and ebay.com.au), we have a notice and take down procedure in the Copyright Act 1968 - see ss 116AA to 116AJ. That couldn't happen here, could it?
