More on (f)EULAs


FEULAs I hear you ask? Ed Foster over at The Gripe Log (in the USA) has started a very interesting project - a model Fair End User Licence Agreement but matters don't end there ...

First, you can find the text of the current draft - BETA .90.2 here as a wiki -

BUT (and this is the more part) there is also a continuing discussion about what the wording is or should be for various clauses here.

Bear in mind, however, (unlike most of those draft agreements the other side sends you to comment on) that while the technical issues are the same here (in Australia) the legal issues may be very different. For example, s 47H of the Copyright Act 1968 renders agreements that prohibit reverse engineering permitted by s 47D of "no effect". There is no statutory US counterpart to that, but clause 3 of the FEULA doesn't prohibit reverse engineering either.
