Patent contingency fee arrangements 


Prof. Goldman reports on things to think about when considering acting for a patentee plaintiff on a contingency basis.  Apparently, Stephen Susman, who spends 70% of his time acting for patentee plaintiffs on a contingency basis, starts on the assumption that his firm will incur US$3 million in attorney fees and US$2 million in out of pocket expenses.

Before he takes on a case, his firm spends around US$100,000 doing due diligence (including validity and infringement opinions).
