Terms of Business
In any exchange of fees or other monies or entering into a contract either verbal or written, these terms of business apply to any and all transactions unless overridden explicitly by Sheldon King in writing.
Charges and Fees - The following schedule outlines fees and charges that apply for services for 2008-2009 Australian financial year.
Base Fees
Standard Hourly Fee for services AU$200
Travel
One half of the Standard Hourly Rate per hour
Out-of-hours Levy
Core consulting hours are 8am to 6pm business days. To assure your business continuity, tasks can be undertaken outside of these times by arrangement. A loading of 35% may apply for any tasks or travel undertaken out-of-hours.
Processing Fees
Cancellation Fee [less than 24 hours notice] one hour @ Standard
Cancellation Fee [more than 24 hours notice] -none-
Cancellation Fee [upon arrival at site] two hours @ Standard
Fees will be invoiced directly and terms are due for payment strictly within the Project Terms.
A charge of AU$75 is applied to late notices.
A charge equal to 10% of the outstanding total may be leveraged monthly (compounding) on any invoice amounts and late fees outstanding after 60 days.
Fee for issue of duplicate overdue invoices AU$50.00
Notifications
Issue of notification of third party error or failure to perform under contract

[2nd and subsequent issues] - 1 hour @ Standard
Personal visits on matter of third party operating error are charged at base hourly rate
Issue of notification of failure to provide contracted services - 1 hour @ Standard

Liability
I may not be held liable for any loss of data or subsequent losses. I endeavour to complete tasks to specification and will apply correction within the scope of any work commissioned at my discretion.
Notice of Third-Party Contract and Terms Variations, Service Notifications and Account Changes
It may be deemed that I have received notice when one of the following occurs:
-Written notice is despatched to my current mailing address, with appropriate postage paid and an allowance or reasonable time for delivery is made
- Electronic mail is despatched with direction to a secure online facility containing details of the variation and online acknowledgement is sought in an authenticated session access to which is obtained and verified using the login, password, token or certificate provided by the third party
The following are not to recognised as methods of conveying variation information:
- Changes to electronic versions of terms [such as but not limited to websites] where no online acknowledgement is sought in an authenticated session
- Advertisements in the press
Disputes
Any dispute of invoiced amount must be made in writing to the remittance address and before the due date of any invoice. No correspondence will be entered into with regards invoicing after the due date.
Revision
These terms of business may be revised from time to time, and will be made available publicly via the world wide web.
