Iqaluit Dog Team By-Law is Officially on the Books

After much deliberation, discussion and hard work, the Canadian Inuit
Dog and Dog Team By-Law for the Town of Iqaluit, Nunavut was officially
adopted and put into effect earlier this Spring. This 5,000+ word
joint effort of Municipality officials, dog team owners and other citizens
appears below in its entirely (except for the appendices). Huge thanks
to Iqaluit resident and dog team owner Ken MacRury for making this available
to the Fan Hitch.

CANADIAN INUIT DOG AND DOG TEAM BY-LAW
WHEREAS public safety is the utmost concern of the City.
WHEREAS there is potential danger to humans by nature of both Dogs and
Dog Team Activity.
WHEREAS the Canadian Inuit Dog is the last indigenous dog to North America
and is rare and distinct.
WHEREAS the Canadian Inuit Dog and Dog Team activity have been an integral
part of the survival and flourishing of Inuit and are
an integral part of the City of Iqaluitís unique character and its
economic and tourism development.
WHEREAS the Canadian Inuit Dog is recognized as the official animal
of Nunavut by the Legislative Assembly of Nunavut.
WHEREAS the City wishes to manage the inherent risk and the preservation
of Canadian Inuit Dogs and Dog Team activities through thoughtful and reasonable
regulation and enforcement.
WHEREAS the Cities, towns, and Villages Act R.S.N.W.T. 1988 C-8 Section
115 and Section 116 provides for the passage of By-laws to control, license
and the prevention of cruelty to animals.
WHEREAS the City wishes to acknowledge and reference that it has a Domestic
Animal Control By-law for the control, license and prevention of cruelty
to domestic animals.
BEING A BY-LAW of the Municipality of Iqaluit, Nunavut to provide for
public safety and the preservation of Canadian Inuit Dogs and Dog Team
activities through responsible management, regulation and enforcement.
NOW THEREFORE PURSUANT to the provision of the Cities, Towns and Villages
Act, the Council of the Municipality of Iqaluit, Nunavut at the regular
session duly assembled, enacts as follows:
SEVERABILITY
If any provision of the By-law is declared invalid because of any word,
phrase, clause, sentence, paragraph or section of the By-law or any documents
which form part of the By-law or an application thereof to any person or
circumstance is declared invalid, the remaining provisions shall not be
affected thereby but shall remain in force.
SECTION 1 - SHORT TITLE
1. This By-law shall be known and may be cited as the Canadian Inuit
Dog By-law of the Municipality of Iqaluit.
SECTION 2 - INTERPRETATION
In this By-law the following terms (unless the context specifically
requires otherwise) shall have the following meanings:
"Animal Control Officer" shall mean a By-law Officer appointed by the
Municipality to do any act or perform any duties under this By-law and
includes a member of the Royal Canadian Mounted Police and, when authorized,
a Special Constable and any person acting under the authority of an Animal
Control Officer.
"At Large" shall mean where a Dog is at any place other than the Property
of the Owner or Designated Dog Team Area and is not being carried by any
Person or is not otherwise restrained by a Permitted Leash held by a person
capable of controlling the dog and that leash is attached to a choke chain,
collar, or harness securely holding that Dog;
"City" shall mean the legally incorporated Municipality, Town or City
of Iqaluit.
"Canadian Inuit Dog" shall mean any dog that has the general physical
characteristics of the official animal of Nunavut (as identified by the
Government of Nunavut) and/or of the recognized breed with the Canadian
Kennel Club and/or the Inuit Sled Dog International and/or The Canadian
Eskimo Dog Association.
"Council" shall mean the Council of the Municipality of Iqaluit.
"Designated Dog Team Area" shall mean an area designated in accordance
to this By-law and listed in Appendix "G" and additions thereto for
the keeping of one or more Dog Teams.
"Dog" shall mean a Canadian Inuit Dog or a Dog Team Dog.
"Dog Team" shall mean a Dog Team Dog or any number of Dog Team
Dogs used for pulling a sled or qamutik or a wheeled vehicle be it for
traditional activities, and/or recreational activities, and/or sport, and/or
expeditions, and/or tourism activities (outfitting, eco-tourism).
"Dog Team Activities" shall mean those activities of using Dog Team
Dogs for pulling a sled or qamutik or wheeled vehicle be it for traditional
activities, and/or recreational activities, and/or sport, and/or expeditions,
and/or tourism activities (outfitting, eco-tourism).
"Dog Team Dogs" shall mean those Canadian Inuit Dogs, and any
other Dog that would reasonably be considered to be a Dog Team Dog by virtue
of similar appearance or similar function to traditional dog team
dogs, registered by a Dog Team Owner as being a part of a Dog Team.
Dog Team Dogs shall include all puppies under the age of six months that
have not been registered.
"Dog Team Owner" shall mean person, persons, proprietorship or body
corporate that owns, cares for and uses a Dog Team Dog for Dog Team
Activities.
"Designated Dog Team Routes" shall mean access and egress routes
to and from Designated Dog Team Areas as identified along with respective
Designated Dog Team Areas in Appendix "G" and amendments thereto.
"Identification Tag" shall mean a tag issue by the Municipality to
identify Dog Team Dogs.
"License" shall mean a License issued by the Town in accordance to
the provisions of this By-law.
"License Tag" shall mean an identification tag issued by the Town showing
the license number for a specific Dog in a Dog Team.
"Microchip" shall mean a microchip device inserted sub-cutaneously
into a Dog Team Dog for identification purposes.
"Municipality" shall mean the legally incorporated Town or City of
Iqaluit.
"Municipal Dog Shelter" shall mean premises designated by the Municipality
for the impoundment and care of dogs.
"Original Dog Team Designated Area" shall mean the original list of
Designated Dog Team Areas as approved by Council in Appendix "G" of this
By-law upon the adoption by Council of this By-law.
"Person" shall mean an individual, individuals, proprietorship or body
corporate.
"Planning Committee of Council" shall mean the committee of Council
established in accordance with the Council Procedures Bylaw.
"Possession" shall mean having physical or effective control of a Dog
or a Dog Team; or having given physical or effective control of a Dog or
Dog Team to another person for the purpose of controlling the Dog or Dog
Team for a period of time.
"Rabid Dog" shall mean any dog suspected of or having rabies.
"Tether" shall mean a chain or other similar device used to restrain
a Dog.
"Town" shall mean the legally incorporated Municipality, Town or City
of Iqaluit.
"Town Dog Shelter" shall mean premises designated by the Town or City
for the impoundment and care of dogs.
"Vicious Dog" shall mean any Dog with a known propensity, tendency
or disposition to attack, without provocation, any person or animal
notwithstanding the territorial nature of the Dog;
"Violation Ticket" shall mean a ticket as defined in the Summary Conviction
Procedures Act, as amended.
SECTION 3 - NUNAVUT LAND CLAIMS AGREEMENT
1. In accordance to the Nunavut Land Claims Agreement, this By-law
shall not impose on any Inuk, as defined by the Nunavut Land Claims Agreement,
any form of license or permit or impose any form of tax or fee if a Dog
Team is used for harvesting purposes.
2. In order to be exempt from any form of license or permit or any
form of tax or fee that may be imposed under this By-law, an Inuk must
make a declaration in accordance to Appendix "F" of this By-law that he
or she is using is or her Dog or Dog Team for harvesting purposes.
3. An Inuk, as defined by the Nunavut Land Claims Agreement, shall
not be exempt from any other aspect of this By-law.
SECTION 4 - EXEMPTION FROM ANIMAL CONTROL BY-LAW
1. Dogs that are registered in accordance to this By-law shall be exempt
from the Animal Control By-law or any of its successors.
SECTION 5 - DOG CONTROL PROVISIONS
1. No Person shall release any Dog from the Town Dog Shelter or a vehicle
in which a dog has been placed after seizure without having first been
authorized to do so by a Dog Control Officer.
2. No Person shall untie, loosen or otherwise free a Dog that is in
the custody or control of a Dog Control Officer.
3. No Person shall alter, deface, or damage the figures, letters or
markings of any dog tag issued under this By-law.
4. An Owner shall not permit or suffer to permit a Dog to be At Large.
5. An Owner whose Dog unreasonably barks or howls so as to disturb
the quiet, peace and repose of any person is guilty of an offense.
6. An Owner of any Dog which has damaged any Public Property Area or
private property not the Property of the Owner within the municipal boundaries
of the Town is guilty of an offense.
7. The Town may post signs indicating Public Property Areas where Dogs
are not permitted, and an Owner whose Dog is in a Public Property area
where a sign may prohibit the presence of Dogs, whether At Large or under
the control of such Owner, is guilty of an offense.
8. An Owner of a Dog, whether in care and control of the Dog or not,
may be guilty of an offense if such Dog without being provoked:
a) attacks, threatens, or injures any Person; or,
b) chases any person while such Person is on foot or bicycle; or,
c) attacks, injures or kills any animal belonging to any other Person.
9. Any Person who kills a Dog of which he is not the Owner may be guilty
of an offense. This section does not apply to: a Dog Control Officer
acting pursuant to this By-law.
10. Where a dog defecates on any public property or private property
other than the property of the Owner or a Designated Dog Team Area, the
owner shall immediately cause such defecation to be removed in a sanitary
manner.
11. An Owner of a Dog shall ensure that when that Dog is in a Vehicle
that the Dog is either enclosed within the Vehicle or if the Dog is in
the uncovered box of a truck that the Dog is tethered in such a manner
as to ensure that the Dog can not fall out of or otherwise escape the truck.
12. Any Person interfering with, hindering or impeding a Dog Control
Officer in the performance of any duty authorized by this By-law is guilty
of an offense.
13. Any person may take charge of any dog or dogs At Large and as soon
as possible deliver the dog or dogs to a Dog Control Officer.
SECTION 6 -VICIOUS DOGS
1. Any dog shall be deemed to be vicious or a public nuisance if it
has made an unprovoked attack upon any Person or domesticated animal in
the course of which such Person or animal is bitten or injured or where
such Person suffers damage to his/her clothing or personal property.
2. In the event that a Dog is determined to be a Vicious Dog pursuant
to this By-law, the Vicious Dog provisions of this By-law shall apply
upon the Owner of a Vicious Dog receiving written notice that the Dog has
been determined to be a Vicious Dog.
3. An Owner of a Vicious Dog shall keep the Dog confined within a Municipality-approved
secure enclosure.
4. An Owner of a Vicious Dog, while outside the Designated Dog Team
Area and while outside a Municipality-approved secure enclosure,
with a Vicious Dog, shall have the Dog muzzled and on a Municipality-approved
leash held and controlled by the Owner.
5. Any dog deemed to be a Vicious Dog, such dog shall, in the public
interest, be forthwith quarantined by the owner for ten days and if found
to be rabid, destroyed.
6. An agent of the Municipality may enter, at any time, the property
where a vicious dog is kept to ascertain that the provisions of this By-law
are being complied with.
7. Any owner of a Vicious Dog must prevent, at all times, the dog from
being At Large. If such Dog is found At Large, it may - where it
is deemed by the Animal Control Officer to be a clear and immediate
threat to human life - immediately destroyed by the Animal Control
Officer.
8. When a Vicious Dog is off the owner's property, the owner shall
securely muzzle such animal and either harness it or leash it securely
to effectively prevent it from attacking or biting a Person or another
animal.
SECTION 7 - REGISTRATION AND LICENSING PROVISIONS
1. Every Dog Team Owner shall register his or her Dog Team and annually
re-new his or her registration by the 15th of January with the Municipality
in accordance to the fee schedule set out in Appendix "A".
2. Each Dog that is part of a Dog Team, except for puppies under the
age of six months, shall be registered as part of a Dog Team.
3. No person shall own a Dog Team within the Municipality unless the
Dog Team is registered in accordance with this By-law.
4. A Dog Team Owner who does not register or who fails to renew his
or her annual registration is guilty of an offense.
5. A Dog Team Owner shall provide to the Municipality the following
information when registering a Dog Team:
a) Name, telephone number and street address of the Owner.
b) Name and description of the Dog Team Dogs.
c) Proof of vaccination for all Dog Team Dogs in accordance to
this By-law.
d) The whereabouts of the Designated Dog Team Area(s) where the
Dog Team will be kept throughout the year
6. Any person who provides the town with false or misleading information
with respect to any information that may be required in this By-law is
guilty of an offense.
SECTION 8 - IDENTIFICATION OF DOG TEAM DOGS
1. The Municipality shall identify each Dog Team Dog in a Dog Team
by means of dog tag and when and if available from the Municipality
a subcutaneous microchip.
2. Each Dog Team Dog in a registered Dog Team shall be issued an Identification
Tag and shall have it attached to its collar. Dog Team Dog Identification
Tags shall be easily distinguishable from any other tag issued by the Municipality.
3. Any replacement tags shall be issued free of charge by the Municipality.
SECTION 9 - DESIGNATED DOG TEAM AREAS
1. Except as provided in this By-law, Dog Teams within the Municipality
of Iqaluit shall be kept in Designated Dog Team Areas as identified
in Appendix "G" and subsequent amendments to Schedule "G".
2. Upon the adoption by Council of this By-law an "Original Dog Team
Designated Areas" list shall be identified and approved by Council, by
resolution, in Appendix "G" of this By-law.
3. In deciding upon Appendix "G" the list of Original Dog Team Designated
Areas in Section 9.1 above, Council shall consider the history of the Dog
Team Area with respect to safety and thoughtful management by the particular
Owner.
4. A Dog Team Owner may keep a bitch with suckling puppies to a maximum
of 8 months at a residence if confined to a kennel approved by the Animal
Control Officer or at large upon special written approval of the Animal
Control Officer.
5. Exceptions to Section 9.4 may apply, upon written permission from
the Animal Control Officer.
6. A Dog Team Owner may keep any injured or sick Dog Team Dog at a
residence while it is convalescing or being treated for its injuries or
sickness.
7. All Designated Dog Team Areas shall be subject to annual review
with the possibility of revision per the provisions of this By-law.
8. All Designated Dog Team Areas on private property, or that
are owner-specific, or that are in residential areas shall not be
transferable to new Dog Team Owners or to new or other areas.
SECTION 10 - DESIGNATED DOG TEAM AREA SELECTION COMMITTEE
1. A committee, called the "Designated Dog Team Area Selection Committee
(DDTASC)" shall be established by Council, in accordance to its Procedures
By-law. The Committee shall be made up of the following:
a) A Councillor.
b) Two Dog Team Owners
c) Two members at large.
2. The Committee shall be supported administratively by the Municipal
Administration and/or By-law Department.
3. The Mayor shall consult with the Committee before Council appoints
the Council representative to this Committee.
4. The DDTASC shall be responsible for the following:
a) To review and provide input to Council regarding its proposed Original
Designated Dog Team Areas
b) Subsequent to a) above, consider and make recommendations regarding
additions and deletions to the Original Designated Dog Team Areas
based on the Criteria for the Designation of Dog Team Areas to be presented
to the Planning Committee of Council for recommendation to Council;
c) To annually review each Designated Dog Team Area and present an
annual report on the "Designated Dog Team Areas" to the Planning
Committee of Council;
d) To provide advice to the Municipality Administration in ensuring
the Designated Areas are well signed, well publicized and on how best to
ensure safety; and
e) To assist in public education efforts with regard to Dog Teams and
Designated Dog Team Areas.
SECTION 11 - PRINCIPLES AND CRITERIA FOR THE SELECTION AND REVISION
OF DESIGNATED DOG TEAM AREAS
1. The principles that shall be used to guide the selection of Designated
Dog Team Areas are as follows:
a) Public safety: Public Safety shall be the upper most
principle for the selection of Designated Dog Team Areas.
b) The preservation of the Canadian Inuit Dog and promotion of
related Dog Team Activities. This By-law shall not in any way serve to
eliminate or unreasonably restrict the Canadian Inuit Dog and related Dog
Team Activities; and
c) The necessity for proper socialization of Canadian Inuit Dogs.
Canadian Inuit Dogs are friendlier and less likely to be dangerous when
they are kept close to humans where interaction with the Dogs is constant
and daily.
2. Based on the Principles set out in Section 11.1 the criteria for
the selection of Designated Dog Team Areas shall be as follows:
a) Designated Dog Team Areas should be in areas which are highly
visible;
b) Designated Dog Team Areas should be in areas where there are
low volumes of human traffic;
c) Designated Dog Team Areas should be away from areas with high
density child populations;
d) Designated Dog Team Areas shall be away from schools, playgrounds,
shopping areas and designated pedestrian walk-ways;
e) Designated Dog Team Areas should be in areas where there is
easy and safe access to the land and/or sea ice;
f) Designated Dog Team Areas should allow for easy access to
the dogs by the Dog Team Owner;
g) Designated Dog Team Areas should allow for the humane keeping of
dogs including but not limited to, access to water in the summer.
SECTION 12 - PROCESS FOR DESIGNATING DESIGNATED DOG TEAM AREAS
BEYOND ORIGINAL DESIGNATED DOG TEAM AREAS
1. Council shall, upon adoption of this By-law, approve the
Original Designated Dog Team Areas, Appendix "G", by resolution
and in conformance with the provisions of this By-law. The following sections
provides for selecting all Designated Dog Team Areas thereafter.
2. Original Designated Dog Team Areas shall be listed in Appendix "G"
and any additions or deletions to the original Appendix "G" shall
follow in numeric order. For illustrative purposes, that is to say
- G-1, G-2, G-3, etc.
3. Request for designation of a Designated Dog Team Area beyond those
Original Designated Dog Team Areas approved by Council in Appendix
"G" shall be limited and considered as exceptions or variances to Appendix
"G".
4. Such variances to Appendix G, may either be accepted or refused
based on the Principles and Criteria for the Selection of Designated Dog
Team Areas set out in Section 9 of this By-law.
5. Request for the Designation of a Dog Team Area shall be submitted
to the Municipality with sufficient information to be able to conduct
an initial screening of the request against the Principles and Criteria
for the Selection of Dog Team Areas. The initial screening of request will
be undertaken by the By-law Department or Municipal Administration.
6. Within twenty (20) working days of receipt of the request,
the Municipality Administration shall either:
a) refuse the request for designation and inform the person making
the request of the reasons for the refusal; or
b) forward the request to the DDTASC for their consideration.
7. Within thirty (30) working days of the receipt of a request for
designation the DDTASC shall consider the request and shall either:
a) refuse the request for designation and inform the Person making
the request for the reasons for the refusal; or
b) approve the request for designation with conditions to reasonably
ameliorate the prevention of incidents. This will as a general rule require
enclosed pens of a prescribed dimension unless reasoned otherwise by the
DDTASC. The DDTASC shall forward its conditional approval to the Planning
Committee of Council; or
c) recommend approval of the request and forward it to the Planning
Committee of Council.
8. In considering a request for designation, the DDTASC may take such
reasonable steps to investigate the appropriateness of the request as measured
against the Principles and Criteria for the Selection of Dog Team Areas,
including, but not limited to:
a) Inviting the Person making the request and any citizens who may
be affected by the designation to meet with the DDTASC;
b) Seeking input from residents from the vicinity of the area.
9. Upon receiving a request for designation from the DDTASC, the Planning
Committee of Council shall consider the request and shall either:
a) refuse the request for designation and inform the DDTASC for the
reasons of the refusal and return the request to the DDTASC for reconsideration;
or
b) recommend Council approve the request.
10. Should a request be refused by Planning Committee the person making
the request may seek to have the request heard by the Municipal Council.
The decision of the Municipal Council shall be final.
11. In considering a complaint of Persons regarding designation, the
DDTASC may take such reasonable steps to investigate the appropriateness
of the complaint as measured against the Principles and Criteria for the
Selection of Dog Team Areas, including, but not limited to:
a) Inviting the Person making the complaint and any citizens who may
be affected to meet with the DDTASC;
b) Seeking input from residents from the vicinity of the area.
12. Should a DDTA be recommended for revocation by the DDTASC to the
Planning Committee and in turn to the Council, the Person facing
revocation may seek to have his concerns heard by the Municipal Council.
The decision of the Municipal Council shall be final.
SECTION 13 - KEEPING DOGS WITHIN DESIGNATED DOG TEAM AREAS
1. Designated Dog Team Areas shall be restricted to people other then
Dog Team Owners, or their designates, and Animal Control Officers.
Any other Person that is found in a Designated Dog Team Area is guilty
of an offense, unless that Person is there to release or aid an injured
or a distressed Dog or a Person in distress.
2. Where not penned, Dog Team Dogs shall be kept tethered on chains
no longer than 2 metres in length. There shall be a minimum distance
of 1 metres between all animals on a common chain.
3. Dog Team Dogs shall be checked by the Dog Team Owner or designate
a minimum of once per day.
4. Dog Team Owners shall feed and provide water as required for the
healthy upkeep of the Dog Team Dogs. Dogs who are determined, by
the Animal Control Officer, to be undernourished shall be apprehended by
the Animal Control Officer after consultation with the Dog Team Owners
who are members of the DDTASC.
5. The Dog Team Owner shall keep vaccinations for each Dog Team
Dog current for the following:
a) Rabies;
b) Distemper;
c) Parvovirus;
d) Adenovirus;
e) Parainfluenza; and other diseases reasonably deemed appropriate
by the Dog Control Officer
SECTION 14 - SIGNAGE AND PUBLIC INFORMATION
1. Signage to indicate the presence of a Dog Team Area shall be provided
by the Municipality to indicate the presence of a Designated Dog Team Area.
2. Signage shall be erected by the Dog Team Owner with the assistance
of the Municipality to inform the public of the presence of a Dog Team
Area.
3. Designated Dog Team Areas shall be kept clean and free of debris
by the Dog Team Owners except in cases where debris is the responsibility
of the Municipality of Iqaluit or a commercial and/or private person.
4. Dog Team Owners shall inform the Municipality Administration when
the Dog Teams are moved from one Designated Dog Team Area to another.
5. The Municipality shall keep the public informed regularly of the
whereabouts of Dog Teams and Designated Dog Team Areas by publication of
a map indicating the Designated Dog Team Areas and by public service announcements.
SECTION 15 - PREVENTION OF CRUELTY
1. No Dog Team Owner shall allow a Dog Team Dog to remain unfed or
unwatered long enough to amount to cruelty.
2. No Person shall punish or abuse a Dog Team Dog in a manner or to
an extent that is cruel or unnecessary.
3. Any Person who teases, torments, annoys, abuses or injures a Dog
Team Dog is guilty of an offense.
4. Unless otherwise authorized by this By-law, any Person who kills
a Dog Team Dog without the authorization of the Dog Team Owner is
guilty of an offense.
5. Unless otherwise authorized by this By-law, any Person, who without
the authorization of the Dog Team Owner, unties or lets loose a Dog Team
Dog that is not in distress, is guilty of an offense.
SECTION 16 - TRAVEL BY DOG TEAM WITHIN MUNICIPAL BOUNDARIES
1. Dog Teams may be driven on such roads and paths within the Municipality
in a safe manner so as to access the land or sea ice from a Designated
Dog Team Area. These routes shall be called "Designated Dog Team
Routes" and shall identified and form part of Appendix "G" and amendments
thereto based on access and egress to/from the Designated Dog Team Areas.
2. These designated Dog Team Routes shall be appropriately identified
with signage and other means.
3. Dog Teams shall be driven in a safe manner on these designated dog
team routes.
4. Dog Teams shall have the right of way when encountering other vehicles
on theses designated routes. Other vehicles shall give Dog Teams ample
space to be able to continue traveling.
5. Dog Teams may be driven in a safe manner in other areas of the Municipality
when participating in a special event and with the written permission of
the Municipality Administration.
SECTION 17 - POWERS OF THE DOG CONTROL OFFICER
1. Except as otherwise provided herein, a Dog Control Officer is empowered
to carry out the duties described herein and to enforce the provisions
of this By-law.
2. A Dog Control Officer is authorized to capture and impound
in the Municipality Dog Shelter any Dog Team Dog which is At Large.
3. Notwithstanding any other provision of this By-law, an Animal Control
Officer is authorized to capture and impound any Dog Team Dog that he or
she has reasonable grounds to believe has pursued or attacked a Person
or other animals.
4. Upon capturing and impounding and a Dog Team Dog, the Dog Control
Officer shall immediately attempt to contact the Dog Team Owner and shall
continue to attempt to contact the Dog Team Owner until the Dog Team Dog
ceases to be impounded per the provisions of this By-law.
5. All impounded Dog Team Dogs must be kept in the Municipality
Dog Shelter for a minimum period of seventy-two (72) hours. Sundays
and Statutory holidays shall not be included in the computation of the
seventy-two (72) hour period. During this period, any Dog Team Dog
may be redeemed by the Dog Team Owner, except as otherwise provided in
this By-law, upon payment to the Municipality or its authorized agent if:
a) The appropriate impoundment fee as set out in Schedule "A" of this
By-law; and,
b) The appropriate License Fee when the Dog Team Dog is not licensed
pursuant to this By-law; and,
c) The cost of any treatment of any Dog Team Dog that is found to be
injured when captured or injured in the process of capture.
6. A Canadian Inuit Dog that is impounded and cannot be identified
or should remain unclaimed after seventy two (72) hours, the Dog Control
Officer shall give notice to all other Dog Team Owners and allow any Dog
Team Owner to claim the Dog Team Dog.
7. If at the end of the period of impoundment, the Dog Team Dog remains
unclaimed, the Dog Control Officer may:
a) If suitable, offer the Dog Team Dog for sale;
b) Destroy the Dog Team Dog in a humane manner;
c) Allow the Dog Team Dog to be redeemed in accordance with the provisions
of Section 17.5 of this By-law; or
d) Continue to impound the Dog for an indefinite period of time.
8. Upon payment of a fee as set out in Schedule "A" of this By-law,
a Dog Control Officer may destroy a Dog Team Dog when the Dog Team Owner
signs a form approved by the Town Administration indicating that the Dog
Team Owner waives all rights of ownership and requests the Municipality
to destroy the Dog Team Dog.
9. If a Dog Team Dog is reasonably believed to have rabies, the Dog
Team Dog may be seized and turned over to the RCMP or Renewable Resources.
SECTION 18 - PENALTY PROVISIONS
1. Any person who contravenes any provision of this By-law is guilty
of an offense and is liable on summary conviction to a fine as set out
in Schedule "XX" of this By-law.
2. An Animal Control Officer who has reasonable grounds to believe
that a person is violating any provision of this By-law may give such person
written notice of intention to prosecute in the form of a ticket as defined
in the Summary Conviction Procedures Act, and amendments thereto, setting
forth the date, time, and place of the offense; briefly stating the nature
of the offense; stating that payment may be made under this By-law.
3. A person who has received a ticket pursuant to Section 16 in respect
of an alleged offense under this By-law, may, after receipt of such ticket,
in lieu of prosecution under this By-law, pay to the Municipality such
penalty as is set out in Schedule "B" attached hereto and part of this
By-law.
4. Any person who violates a provision of this By-law and does not
pay the imposed fine is liable to prosecution under the Summary Convictions
procedure Act.
5. No compensation or damages shall be paid to an owner whose dog has
been injured, destroyed or otherwise disposed of, pursuant to this By-law.
