Perché Judith Miller è andata in galera? Secondo Michael Kinsley c'è una specie di comma 22.

“In a ringing and utterly uncompromising editorial Friday, the New York Times noted correctly that even its earlier editorials about the need to expose and punish "an egregious abuse of power" had warned against any "attempt to compel journalists to reveal their sources." But these directives are irreconcilable. The "egregious abuse of power" was leaking secret information to journalists. The leaker has a Fifth Amendment right not to testify. If journalists have a First Amendment right not to testify, then the "egregious abuse of power" cannot be exposed or punished.„

In ogni caso l'uccellino che ha cantato il nome della Plame dovrebbe essere - secondo Newsweek - Karl Rove. Ma la cosa buffa è che non è detto che possa essere incriminato per quello che ha fatto. La legge infatti non punisce un pubblico ufficiale che rivela un nome di un agente "coperto" se questo pubblico ufficiale non è conscio del carattere "coperto" dell'incarico dell'agente. E con un buon avvocato di solito non si è affatto consci di quello che si fa se questo è un crimine. Resta il problema del fall-out politico: ma Rove è un maestro nello schivare questo genere di ricadute.
