Consumer Legal Remedies Act

The Consumer Legal Remedies Act (or CLRA) is a statutory scheme enacted by the California legislature to protect consumers from unlawful practices by sellers of consumer goods and services. (California Civil Code section 1750, et seq.) It provides the consumer with a wide range of remedies including actual damages, restitution of property, injunctions, costs and attorneys fees.

What big business did wasn't fair, but the damage was so small -- it is not worth filing a lawsuit over it. That is what most victims think, and unfortunately, that is what many companies out there rely on. If you cheat one person out of $1,000,000, you will likely be sued, but if you cheat 1,000,000 persons out of $1.00 each, you will most likely get away with it. No one in their right mind would sue for $1.00. However, the CLRA allows actions to be brought as a class action -- representing all similarly situated consumers. Thus, a million $1 claims can be combined into one suit. Finally, it makes economic sense to pursue legal action and the consumer has a fighting chance against big business.
