The article analyzes the East German border guards cases in which the courts of unified Germany tried and convicted East German border guards for killing people trying to escape from East Germany to the West. The cases raise issues of epistemology, natural law and positivism, transitional justice, and the communicative force of law. Discussed: Gustav Radbruch, H.L.A. Hart, Robert Cover, and BŠrbel Bohley.
