From a legal point of view -- if something was not patented or not even patentable -- there is no case to talk about. IP (intellectual property) laws are a fairly clear thing, although using them is not always for the faint of heart. The simple fact that they work gets us paid for writing code or copy and for drawing logos or landscapes. From my experience I can confirm that in creative industries dogs who bark don't bite: when a party becomes very vocal about something being ripped off or stolen, they usually don't have a case. When they have a case, things are happening in silence. Top lawyers cost top dollar that no one is dumb enough to mess around with. Only noise is for free.
