Why doesn't this bother iPod owners?

I've got an iPod 40GB. 40GB on the box, on the Apple website and in their ads, yet I can only put 37.x gigabytes on it (iPod Updater states that I have 37.3GBs available after I restore the iPod). So what happened to the difference, or about 3GBs? Does the iPod require 3GBs of software to do its thing? Perhaps, but I doubt it.

Sure, I'm missing less than 10%. Not much considering that 37GBs is a ton of space. But when you consider that I paid $499 for it (3G) and an iPod mini has about 4GBs (remember, you're not getting 4GBs in total), I sort of feel like I was gypped out of the equivalent of an iPod mini.

I'm not harping on Apple alone. Look at any storage device and its spec sheet and the tale of the tape comes up short. 10% seems to be the average shortfall.

So why don't we care? Why isn't this something that consumers are protected from? If Nabisco shipped 14 ounces of Wheat Thins in a box labeled 16 ounces you can be sure that the biscuit maker would be on/in the news and there'd be class action lawsuits sitting on their desk.
