Where do I get that reporter?
So, today I wake up and am watching the news.
Not that I like to, but there isn't really much on as I am about to leave for
work.
Mat Lauer was discussing the
finer details of the Michael Jackson case with one of their remote reporters. I
found the conversation interesting as the reporter began to regail that in this
case, Michael Jackson had not (and I am paraphrasing here because I don't have
the exact quote" .... demonstrated any of the behavior indicative of a child
molester. Typically one would find kiddie porn downloaded from the internet and
the like. It was at this point that Matt Lauer pointed out that there had been
pictures of naked children found - to which the reported responded - yes, but
that it wasn't kiddie porn.
Now -
excuse me for having to point this out. BUT, apparently this reporter hasn't
really looked around at the climate of the society today. Nor does he have an
understanding of what our government uses as a definition of child pornography,
according to U.S. Title 18, Part I, Chapter 110, Section 2256 the definitions
are:
"Minor" means any person under the
age of 18 (eighteen years)
"Sexually Explicit
Conduct" means actual or simulated lascivious exhibition of the genitals or
pubic area of any person
The key
phrases here are "minor" and "actual or simulated lascivious exhibition of the
genitals or pubic area of any person". Now while the photographs may not have
been lascivious - but they were definitely of a nude minor, according to both
reporters. So, if the field reporter is making judgements as to whether or not
the pictures constitute something of a lascivious nature - then he is reporting
more than just the news, he is reporting his opinion - especially since most
Congressmen cannot agree on what is
lascivious.
One thing almost all agree
upon however, is that if you have nude pictures of a minor - you are guilty of
child pornography. No ifs, ands or
buts.
And - have you read what Alberto
Gonzales (DOJ) says about porn these days? I'll just leave it at
that.
