Irwin Seitelman's Opinion on Baywinds $27,500 Settlement Agreement

Bernie,

The entire community of Baywinds owes a huge debt of gratitude to you and your small band of stalwart residents who stuck with the lawsuit to the bitter end. Having taken two years from your lives to get this thing finally settled must give you a well deserved sense of satisfaction.

The community of Baywinds will never realize how hard you people worked to get justice for all of us here in Baywinds. The intransigence of both the old board and Mr. Krivok, the association's lawyer, resulted in sizeable outlays of monies that could have been better spent in Baywinds behalf. Had the old board, advised by Mr Krivok, followed the documents, as written, along with the Florida statutes, this entire issue would have been settled in 2006, with minimal or non outlay of funds.

Now the only issue remaining is a non-monetary one. That is to decide how to work with the original documents and bring our present structure in line with what was originally stated and intended.

Hopefully, all of the animosity against you & your team (including past members), has faded. All that remains is the memory of wasted time and money.

All Baywinders should have learned an important set of lessons. Some of these are:

1.) Turning one's back on issues & problems does not make them vanish.
2.) All citizens must participate in their own governance, else a dictatorship can arise.
3.) There's no such thing as a benevolent dictatorship.
4.) Laws, rules, statutes, etc. can be implemented to help or harm the citizenry
5.) Citizens have a responsibility to self & to others to oversee that the governing body does no harm.
6.) Letting someone else perform your responsibilities is NOT good citizenship
7.) Having authority does not automatically equate to being right.
8.) Keeping a governing body honest is a task for ALL, not just the few attendees at meetings.
