The Proposal, which was passed by the residents on April 26th, directs Lennar to amend the original Master Document By-laws from 3 to 9 Board members voted on by the community at-large to a 12-member Board with one representative from each neighborhood.
The vote on or about May 26th will be on whether the members will be the Presidents from their respective communities or an individual elected by each community. Once the results of the vote are known, Lennar will file the appropriate amendment with the State PRIOR to turnover. Doing so before turnover avoids the requirement of getting two-thirds of the Master Board AND 75% of the homeowners to make the same amendment after the turnover.
Therefore, when Lennar sends out the new proposals, you must make a choice on how the Master Board HOA will be chosen. Lennar is only offering us the two choices stated below. The third option of keeping the original by-laws, which was requested by Max Harper at April’s meeting, was denied.
If you choose to directly elect your neighborhood representative to the Master HOA, then each homeowner will have the opportunity to run for the Master Board within each respective neighborhood.
The other choice is for your neighborhood president to automatically be a Master Board member. Remember, you do not elect your president. You elect people to serve on individual homeowner associations. The board then chooses who will be president, vice-president, etc. It does not mean that a person, who becomes president, would be the choice for a neighborhood president, or a choice for representative to the Master Association.
If you feel that you do not want your president putting the time and effort into two major positions, but you want your president concentrating on YOUR neighborhood, we urge you to reject this proposal.
Also, there may be an individual who would want to serve as your president, but not on the Master Association Board. Will you run the risk of losing a competent and highly desired individual as your president?
By voting for direct elections you are allowing any individual, even your neighborhood president, to run for the position on the Master HOA. Direct elections give all homeowners of Baywinds the right to choose!!
What is being voted on now will only go into effect at the 2006 Master Homeowners Association Annual Meeting. We encourage all homeowners to cast their vote.
