Howard Horowitz's Opinion on the State of Baywinds

Many years ago a great President, Abraham Lincoln, enunciated the famous saying: “You can fool all the people some of the time, some of the people all of the time, but you can’t fool all of the people all of the time”.  Mr. Lincoln prophetically had Baywinds in mind when he uttered those words.

I know that all of  you are aware of the existing litigation concerning our HOA.  I also know that many of you find it difficult to comprehend why this case was brought and the nuances thereof.  Therefore, I have no intention of burdening you with the facts about fraudulent Board meetings, illegal turnover proceedings and the fact that even the HOA attorney thinks the legality of our Board is in question.  While what I have to say is not yet the subject of additional litigation, possibly the fact that I am pointing this out will make you aware of the fact that our Board should be recalled and replaced by a legally elected and competent group.

Our front gate is still inoperable from the day of Hurricane Wilma.  It seems that our Board and MMI are incapable of having such a relatively simple item repaired and/or replaced.  It is interesting to note that in the time that this gate has been inoperable and broken, Iran has managed to develop atomic weapons. 

More importantly is the issue of our clubhouse roof.  When we bought the clubhouse from Lennar for $6 million, we insured said clubhouse for the full amount.  This meant our Board insured the structure and all the surrounding land and empty parking lots.  Lo and behold along came Hurricane Wilma damaging our roof to the extent that it allegedly must be replaced.  Because the empty land was also insured we have a $300,000 deductible, not to mention that we are paying too much for our insurance premium.  I have asked, to no avail, for the Board to produce a copy of the independent appraiser’s report as to the value of the clubhouse.  I now ask for the Board to produce a copy of our insurance policy.

Our Board is engaging an independent adjuster at the cost of more of our money in an attempt to get more from the insurance company.  We all know, as was pointed out by Marvin Levine at a Board meeting, that there is an individual in Sapphire Cove, who is more than competent to handle this situation.  The question is why hasn’t the Board called upon this individual?  Or do they like doing it their way, costing us money?

There has been a resident of our development who advocates repairing the roof for much less money.  He has been ignored by the Board and by MMI.

Hurricane season starts in June.  We still do not have a contract for the replacement nor the repair of the clubhouse roof.  What happens if we have another hurricane before the repair is completed, causing more devastation to the roof and possible damage to the clubhouse itself?   I sincerely hope that all of our residents will heed these warnings and take them to heart and ask for answers at our next Board meeting.
