Buyers and sellers, please make careful note of the following disclaimers, warranties, legal statements and trademark notices concerning the content of our web site, the products we sell, and the manner in which we conduct business:
DIGITAL MEDIA KITCHEN is a BROKERAGE company for "used" AVID® systems, other non-linear editing systems and related parts, supplies and equipment. DMK merely acts as the connection point between independent buyers and sellers and vice versa. Digital Media Kitchen is neither an authorized reseller nor a representative of AVID®, or of any other manufacturer. Digital Media Kitchen has absolutely no affiliation, connection or association to AVID Technology, Inc or any other manufacturer listed within this site. AVID® is a registered trademark of AVID Technology, Inc of Tewksbury, MA. All product names appearing anywhere on this web site may be trademarks of their respective owners. All photographs appearing within these pages are also copyright of their respective owners. AVID, Avid Xpress, Media Composer, Symphony, Nitris, Adrenaline and Meridien are either registered trademarks or trademarks of Avid Technology, Inc. in the United States and/or other countries. Any warranties and/or guarantees offered are those made by the sellers themselves, not AVID Technology, Inc or any other respective manufacturer. Buyers and sellers are reminded that the licenses for Avid® software mentioned in the systems listed on this web site may not be transferred without Avid's approval. To transfer the licenses for the software contained in each system, buyers and sellers must contact Avid directly (or other said manufacturer) for the appropriate software license transfer forms and approval(s). Thanks for your cooperation in this matter.
The following is a disclosure of warranties offered on Digital Media Kitchen's equipment sales: Customers are granted three business days (including day of arrival, if before noon in customer's time zone) to inspect the equipment. This "right of inspection" is intended to make sure all equipment has arrived and working as advertised. During this time, customers are entitled to ask for any missing parts and/or components or a full exchange of any broken items (so long as shipper was not responsible for damage- see below). A return of all goods with a full refund is granted should the equipment be non-functioning or misrepresentative of the original sales agreement. In such cases, Digital Media Kitchen agrees to pay the return shipping on the system during the inspection period. The customer, however, carries this burden if the reason for return is non-contractual in nature (i.e the equipment is fully functional but customer arbitrarily decides to return the goods, or equipment is damaged through fault of customer's own negligence). It should also be understood that DMK DOES NOT allow returns for misdiagnosed issues (ex: customer orders replacement part in hopes of resolving a problem, and installation of DMK's new part does not bring resolution). We therefore implore our customers to troubleshoot and carefully run system test(s) prior to purchase to ascertain what will or will not work within their given situation(s), configuration(s) or parameter(s). DMK DOES NOT allow returns for mistaken orders (ex: customer thought they were ordering an AVID Nitris but told us an "Adrenaline"). DMK DOES NOT allow returns for lost work (ex: customer orders an AVID® for a job with their client and the job is cancelled after reception of our system). After the three business day right of inspection period has expired, no returns, refunds or exchanges will be allowed for any reason, and the sale is considered "final".
IMPORTANT: Should the equipment be lost or damaged within shipping, the allocated shipper (FedEx, UPS, BAX, etc...) will be held responsible. We strongly recommend that our customers choose the full insurance coverage offered by major shipping companies to ensure adequate protection. If shipping damage is suspected, retain all original boxes (DO NOT THROW THEM AWAY). Take photographs of the boxes, the packaging (inside and out), and any damaged items immediately from as many angles as possible. Take detailed notes and keep all tracking numbers and shipping invoices in a safe place. These items will be crucial if you are required to file a claim against the shipping agency.
